Terms of Service

These Terms of Service ("Terms") govern your access to and use of TalleUP Golf (the "Service"), provided by Communicating Cloud AI Inc. ("Company", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Account

You must provide accurate information and keep your credentials secure. You are responsible for activity on your account.

2. Subscriptions and trials

Paid features may be offered on a subscription basis. Trials convert to paid plans unless cancelled before the trial ends. See our Refund Policy.

3. Acceptable use

You agree to comply with our Acceptable Use Policy. We may suspend or terminate access for violations.

4. Intellectual property

The Service, including all software, designs, text, graphics, logos, trademarks, algorithms, models, and any other content provided by us, is owned by Communicating Cloud AI Inc. and is protected by Canadian, United States, and international intellectual property laws. All rights, title, and interest in and to the Service and the underlying technology, including all derivatives and improvements, are and remain the exclusive property of Communicating Cloud AI Inc. No license is granted except as expressly stated in these Terms. "TalleUP", "TalleUP Golf", and related marks are trademarks of Communicating Cloud AI Inc.

5. Your content

You retain ownership of the data you submit (e.g., player names, scores). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display that content solely to operate and improve the Service.

6. Feedback

Any feedback or suggestions you provide may be used by us without restriction or compensation to you.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMUNICATING CLOUD AI INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless Communicating Cloud AI Inc. from any claims arising out of your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access at any time for any reason, including breach of these Terms. You may stop using the Service at any time.

11. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws principles. The exclusive venue for disputes is the courts located in Ontario.

12. Changes

We may update these Terms. Continued use after changes constitutes acceptance.
